Terms of Service

Draft. This is a starting template written for CROSS PSA. Have a California attorney review and adjust it before you accept payments. It is not legal advice.

Last updated: [date]

These terms are an agreement between CROSS PSA (“we”) and the business that subscribes to CROSS PSA (“you”). By creating an account or starting a subscription, you agree to them.

1. The service

CROSS PSA is software for pest control businesses to manage customers, scheduling, service records, product records, reports and invoices, through our mobile apps and website.

2. Accounts and seats

The person who purchases a plan is the account admin and is responsible for the account. Each plan includes a set number of user seats. The admin issues invite keys to team members; each key is single-use and occupies one seat until it is used or removed. You are responsible for everything done under your account and for keeping sign-in details secure.

3. Free trial, billing and cancellation

New subscriptions may include a free trial. Unless you cancel before the trial ends, your payment method is charged the plan price and then billed monthly in advance until cancelled. Payments are processed by Stripe. Prices may change with at least 30 days’ notice. You can upgrade, downgrade or cancel at any time from the billing page; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are not refundable.

4. Your data

You own the customer, service and business information you enter (“your data”). You give us permission to store and process your data only to provide and support the service. If your subscription ends, your data is retained in a locked state for at least 90 days so you can renew or request an export, after which we may delete it.

5. Pesticide information and compliance

Product information (such as registration status, EPA registration numbers, active ingredients and signal words) comes from public sources including the California Department of Pesticide Regulation and the U.S. Environmental Protection Agency, and may be incomplete or out of date. Links to labels and safety data sheets are provided for convenience. You remain solely responsible for following product labels and all laws and regulations that apply to your business, including licensing, required notices, record-keeping and pesticide use reporting. Drive-time estimates are approximate.

6. Acceptable use

You agree not to misuse the service, including attempting to access other customers’ data, reverse engineering the apps, reselling access, or using the service for unlawful purposes, and to have your customers’ consent where the law requires it before sending them messages.

7. Availability and changes

We work to keep the service available but do not guarantee it will be uninterrupted or error-free. We may improve or change features over time.

8. Disclaimers and limitation of liability

The service is provided “as is.” To the fullest extent permitted by law, we disclaim implied warranties, and our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental or consequential damages, or lost profits or data.

9. Termination

We may suspend or end accounts that violate these terms or fail to pay. You may stop using the service at any time.

10. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
